Copyright Licensing Agency (CLA) Licence for the NHS in England: Q&A updated 18th May 2009
What period is covered by the current licence?
The licence is backdated to 1 April 2008 and lasts through to 31 March 2010.
Are the terms and conditions the same as before?
Essentially, yes. Connecting for Health tried to negotiate improvements and was successful in some areas but not others. The main enhancement is that the range of 'authorised persons' who may make and receive copies embraces all those employed by, working for and contracted by the NHS. This includes all independently contracted staff, as well as HEI students on placement (whilst on placement), and HEI staff contracted to work for the NHS (whilst contracted).
The following key points remain unchanged:
o Copying must be for 'NHS purposes'.
o The originals must be owned by the NHS.
o You may copy up to two articles from a journal issue (more from a themed issue), and one chapter or 5% of a book.
o Within these extent limits, there is no upper limit to the number of copies that may be made.
o Copies from books and journals published in the UK may be scanned.
o Scanned copies may be supplied via the NHS network but not placed on intranets or websites.
o Only single paper photocopies may be made for patients and carers.
o Publications in the CLA list of excluded categories and works are not covered by the licence.
Remember, the CLA licence covers only published paper books and journals; it does not cover e-books, e-journals or other digital materials, newspapers, or other types of copyright work.
Remember, if copies cannot be made under the terms of the licence, the terms of the 1988 Copyright, Designs & Patents Act (including Fair Dealing and Library Privilege) apply.
